Surrebuttal is a response to an opposing party’s rebuttal – in essence a rebuttal to a rebuttal. Courts may permit surrebuttal evidence where justice requires.9 A defendant has a right to introduce surrebuttal testimony to meet any new matters brought out for the first time on rebuttal. 10
